By downloading, installing, accessing, or using the Habit Tracker mobile application ("App," "Service," or "Application"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Habit Tracker ("Company," "we," "our," or "us").
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.
We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the revised Terms within the App or on our website. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

The App is available for download on the Apple App Store. Certain features may require a paid subscription or in-app purchase.
To use the App, you must be at least 13 years of age (or 16 in the European Economic Area), have the legal capacity to enter into a binding agreement, and not be barred from using the App under any applicable laws.
If you are a minor in your jurisdiction, you must have your parent or legal guardian's permission to use the App, and they must agree to these Terms on your behalf.
4.1 Account Creation: Some features may require you to create or sign in to an account. You agree to provide accurate, current, and complete information.
4.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.
4.3 Account Termination: We reserve the right to suspend, disable, or delete your account at any time for violation of these Terms.
5.1 Premium Features: Habit Tracker offers auto-renewable subscription plans (such as weekly, monthly, and annual) to unlock premium features.

5.5 Refunds: All purchases are final and non-refundable, except as required by applicable law or as determined by Apple's refund policies. For refund requests, please contact Apple Support directly.
6.1 Ownership: You retain ownership of the habits, routines, notes, and other content you create in the App ("User Content").
6.2 License to Us: You grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely to operate and provide the Service to you (for example, to sync your data and generate insights).
6.3 AI Assistant: When you use the in-app AI habit coach, your prompts are processed by a third-party AI provider (OpenAI) to generate responses. Do not submit sensitive personal information in your prompts. AI-generated suggestions are for informational purposes only and are not professional medical, psychological, or financial advice.
When using the App, you agree NOT to:
All content, features, and functionality of the App — including the software, design, graphics, logos, and text (excluding your User Content) — are the exclusive property of Habit Tracker or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and warranties that the App will be uninterrupted, error-free, or secure. Habit Tracker is a productivity tool and does not provide medical, psychological, or professional advice. Your use of the App is at your sole risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, in no event shall Habit Tracker or its affiliates, directors, officers, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the App.
Our total aggregate liability for any claims arising from or relating to these Terms or your use of the App shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).
You agree to indemnify, defend, and hold harmless Habit Tracker and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use or misuse of the App, your violation of these Terms, or your violation of any applicable laws or third-party rights.
12.1 By You: You may stop using the App at any time and may delete your account through the App settings or by contacting us. Note that deleting the App does not automatically cancel any active subscriptions — manage those in your Apple ID settings.
12.2 By Us: We may suspend or terminate your access to the App at any time for violation of these Terms or conduct we believe is harmful to other users, us, or third parties.

These Terms shall be governed by the laws of the jurisdiction where the Company operates, without regard to its conflict of law provisions. Before filing any formal dispute, you agree to first contact us at appskiesltd@gmail.com and attempt to resolve the matter informally for at least 30 days.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Habit Tracker regarding the App.
